HPD Mold Violation Classes — A, B, and C

HPD classifies mold violations under Local Law 55 based on the size of the affected area. The class determines the severity and the deadline to correct and certify with HPD.

Class A — Non-Hazardous

Mold area: Less than 10 sq ft in a room.

Deadline: 90 days from date of service.

Certification: Can be submitted via HPD’s eCertification portal. For buildings under 10 units, a licensed assessor is not legally required — but professional documentation still protects against future disputes.

Mold area: 10–29 sq ft in a room.

Deadline: 30 days from date of service.

Certification: For 10+ unit buildings, requires a licensed mold assessor’s remediation plan and post-remediation mold spore clearance testing (PRV). Must submit notarized paperwork physically to HPD — eCertification not accepted.

Step-by-step guide

How to Remove an HPD Mold Violation

For buildings with 10+ units receiving a Class B or C violation, here’s exactly what the law requires under NYS Labor Law Article 32 and Local Law 55.

1️⃣
Hire a Licensed Mold Assessor (Us)

The assessor must be completely independent from the remediator by law. We inspect the site, identify the root moisture cause, and write a formal Mold Remediation Plan — the legally required blueprint for all work.

2️⃣
Hire a Licensed Mold Remediation Contractor

A separate NYS-licensed contractor reviews our plan, creates a Work Plan, files with NYS Dept of Labor or NYC DEP, establishes containment, and performs remediation using HEPA vacuuming.

3️⃣
Post-Remediation Mold Spore Clearance (PRV)

Metro Mold returns for an independent clearance inspection. We collect air samples and verify mold spore levels have returned to normal, then issue a signed Clearance Report.

4️⃣
Gather Required Documentation

You’ll need: our NYS Mold Assessor License copy, contractor’s NYS Mold License copy, signed Affidavit of Mold Assessment, signed Affidavit of Mold Remediation, and state project filing receipts.

5️⃣
Submit to HPD Before Deadline

For Class B and C in 10+ unit buildings: submit a physical, notarized certification package to your HPD Borough Service Center. eCertification is not accepted for these violation classes.
